By purchasing any of my services, you automatically agree to the following conditions.

You acknowledge that you are purchasing my artistic style and interpretation. Exact replication of another artist’s style or previous works is not guaranteed.

Any breaking of my ToS may result in a strike on your account or blacklisting you from my services.

If you do not agree or feel uncomfortable with my terms, I do not recommend sending a commission request.

Credits to me (@mewynia) must be explicitly given anytime the art is showcased or posted.

Client is to provide clear requirements and expectations upfront, including reference materials, or assets before work begins.

Client grants to the Artist non-exclusive rights to observe and replicate Client’s own character design, reference material and other intellectual property for the use of the Work.

Client warrants that the character design, reference material and other intellectual property provided to the Artist are legally obtained and authorized for use by the Client.

Client acknowledges that Artwork is digital only, meaning there won't be any shipping of physical goods.

Client is not authorized to change, modify, or edit the Artist's work.

Client is not authorized to use Artwork to train AI in any way, shape or form as well as make them into NFTs.

Artist reserves the right to update terms when they see fit with no prior notice.

Artist is expected to deliver what was agreed upon such as subject matter, files, as well as quality that the Client requested and purchased.

Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.

Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more, exempting when some or all of these rights are transferred to the Client under express agreement or project specifications.

Artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe the Client's intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks.

For large-scale commercial, merch, studio, or brand projects, please contact me directly via email to discuss specifics.

Business, studio, and commercial commissions are priced separately from personal commissions.

Quotes are provided after reviewing full project details.

PERSONAL USE - All commissioned art can be made into profile pictures and headers. You may also share/post the art on your social media with visible credit.

MONETIZED CONTENT - All commissioned art can be used for digital/monetized content. This includes branding, logo, advertisements and videos. As it is hard to enforce, it is included in the price of many services that can be used for streaming or promotional content. Credit is still required when due.

COMMERCIAL MERCHANDISING - Selling merchandise or products with my art on it like key chains, stickers and t-shirts is not allowed unless a fee and/or royalties is discussed, agreed upon and paid for.

Any confusion with my usage rights can always be privately messaged.

Unless otherwise stated in writing, an NDA may restrict the Artist from: publicly posting, streaming or sharing the artwork, displaying the artwork in portfolios or promotional materials, discussing project details or the Client’s involvement.

Confidentiality is not assumed by default.

If the Client requires confidentiality regarding the Artwork, project details, or the Client’s identity, an NDA must be requested prior to the start of the project. Which applies only to the specific project agreed upon and do not extend to the Artist’s past or future work.

Unless indefinite, NDAs must include a defined duration and will default to one of the following unless otherwise agreed: until the project is publicly released by the Client or a maximum period of X months from final delivery.

Because NDAs limit the Artist’s ability to self-promote, the following fees apply to INDIVIDUAL/SMALL CLIENTS ONLY:

Standard and extended NDAs are temporary and expire. Permanent NDAs do not expire and permanently prohibit portfolio or public use.

NDA fees account for the loss of promotional and portfolio value when I’m unable to share the work publicly.

NDA fees are non-refundable and must be paid upfront.

Upon expiration or termination of the NDA, the Artist regains the right to: display the final artwork in portfolios and promotional materials, credit the Client unless otherwise requested in writing.

NDA fees are subject to increase if Client is a large company, brand or entity or if the project is in a high-visibility industry (i.e games, fashion).

I reserve the right to decline a commission request for any reason at all.

I only accept a handful of requests at a time to not swamp to myself with work and finish in a timely manner.

Commissions are not on a first come, first served basis. It will be made depending on my artistic choice to maintain quality.

Repeated counts of commissioning a project and failing to pay will result in blacklisting. However, inquiring about a commission is OK and won't result in strikes.

Humans, humanoids, OCs, kemonomimi, fanart, flat-face anthro, slight NSFW, slight gore.

Furries, ferals, excessive muscles, mecha, old People, hyper-realism, babies, animals, complex background/architecture, extreme NSFW, extreme gore (some I am just not confident doing now).

Client must pay in USD, and paid via VGen, Stripe, PayPal, or methods as provided by the Artist.

Client acknowledges prices may vary or change depending on complexity, requirements and/or additional requests.

Client is expected to pay in full prior to work starting.

Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist.

Invoices must be paid within 48 hours, or the project may be cancelled.

Client must request such as alternate versions, lighting changes or layer separations when placing the initial order.

Client is allowed 1-3 small revisions are allowed as long as they are minor. Major or excessive changes or re-sketches will require an additional fee. No changes can be made when the sketch is approved.

Client acknowledges revisions may affect progress and timeline.

Artist provides progress updates and seeks Client feedback voluntarily.

However, if the service is stated as skeb/surprise me, progress updates are not shown to the Client. Client will receive final artwork with mistake fixes available only.

Client will be allowed ten (10) days to approve the WIP before the request is automatically allowed to progress to avoid delays.

Work completion requires 2 weeks minimum, and may take up to 3 months depending on each project.

Timeline depends on commission type, complexity, and workload.

Final files are delivered in the formats specified in the agreement. Source files and editable files are not included unless purchased separately.

If there are any delays and adjustments to timeline, the Artist will inform the Client.

Once final artwork is approved and delivered, refunds are not available.

Client may request a 100% refund if Artist haven't started work yet or 3 months have passed with no progress shown to the Client.

Client can no longer request a full refund once the sketch has been shown.

However, if the Artist no longer wishes to work on the project for any reason at all, Client will receive a full refund no matter what stage the commission is at.

Any back-charging without prior discussion and agreement will result in blacklisting you from ordering in the future.

Client is always welcome to inquire about the progress of their commission. Progress status can also be viewed on Trello.

Both Artist and Client must keep communication friendly and professional.

Client may not send any sexual or unsolicited pieces of media that does not pertain to the commission.

Harassment, aggressive behavior, or repeated disregard for stated terms may result in project termination without refund.

All offers must be serious and fully committed, back-outs are generally unacceptable.

I have the right to refuse any offers, even "autobuys" from people I deem as OC hoarders as I'd like my designs to be used.

If allotted time has passed with no communication or payment from buyer, the design will be placed back up for offer without notice. Buyer is required to communicate first otherwise it'll be taken as ghosting.

Abuse of back-outs, ghosting or deleting offers will result in blocking you and blacklisting you from my designs.

I only accept USD. You are responsible for currency conversions.

I primarily use Paypal invoice when selling designs. Other methods like Kofi and Stripe can be discussed but no promises.

Short payment plans are okay if offer is over $200 as long as a non-refundable down payment is paid upfront.

Small holds up to 1 week are okay only if stated.

Unless the designer (@Mewynia) accepts or offers to buy back the design; no refunds are allowed once an adopt has been purchased.

Back charges results in you being blacklisted, blocked and losing rights to the design which allows it to be resold.

All adopts personally made from @Mewynia are automatically for private use unless stated. Meaning digital monetization and commercial use are not allowed.

This does not apply for custom designs made from commissioning me, those come with full commercial rights (only for design, not the art itself).

Designs on Toyhouse that include commercial rights will have it stated in the ownership tab.

Full commercial rights for personal designs are available for an additional fee. You can message me for more information.

IMPORTANT: You are required to keep an unedited original version of the design tied to the character/profile.

You may rebase or redesign it.

You may NOT make any edits on top of the original. You can on a copy of the file.

You may add it to a closed species.

You must ask before voiding any closed species adopts.

You may trade, sell, swap, or gift the design itself away as long as you do not sell for more than what you purchased it for.

However, gifted designs cannot be sold unless it has art that was commissioned or personally made.

Personal and commissioned art purchased for the design may increase the resell value of the design.

Please keep my design on Toyhouse, do not delete their profiles without permission. You can just send it back to me if needed.

If hiding their profile, grant me authorization in order to keep up with my design. I like to gift art to my designs every so often.

Designs made for a closed species must abide the species’ ToS before my ToS.
