commission t.o.s

general terms

• As the artist, I maintain all and absolute rights to my works; this includes publishing the work on my socials and adding it to my portfolio. I reserve the right to decline any project or client for any reason.• Neither commissioner nor anyone else is allowed to edit, modify, or remove the watermark from the finished product. You are not allowed to claim my art as your own as well.• Credits to me (@mewynia) or a link going back to one of my socials must be explicitly given anytime the art is showcased.

process & payment

• Commissions are not on a first come, first served basis. It will be made depending on my artistic choice to maintain quality.• If your character or request is extremely complex, I have the right to charge a fee to include these details.• Unless a commission is skeb-like/surprise me, the progress of the commission will be provided through screenshots for revisions. Please make sure to make all necessary modifications at the sketch stage, any changes at later stages will incur a 25% - 50% fee based on the original order price.• Client will be allowed 7 days to approve the WIP before the request is automatically allowed to progress.• Depending on the order, it can take 2 weeks to 3 months to finish. I currently do not accept orders with deadlines and rush requests attached.• Repeated counts of commissioning a project and failing to pay will result in blacklisting. Please notify me of a cancellation otherwise the slot may be sold after 48 hours of non-payment. However, inquiring about a commission is OK and won't result in strikes.

refund policy

• You can request a 100% refund if I haven't started the sketch yet.• You can request a 60% refund if you give up your order after receiving the sketch.• You can no longer request a refund once I have started the lineart.• However, If I no longer wish to work on your project for any reason at all, you will receive a full refund no matter what stage the commission is at.• I appreciate any communication when it comes to refunds or emergencies that need to allow for your money back, please message me to discuss further.• Any back-charging without prior discussion and agreement will result in blacklisting you from ordering in the future.

usage rights

• PERSONAL USE - All commissioned art can be made into profile pictures and headers. You may also share/post the art on your social media with visible credit.• MONETIZED CONTENT - All commissioned art can be used for digital/monetized content. This includes branding, logo, advertisements and videos. As it is hard to enforce, it is included in the price of many services that can be used for streaming or promotional content. Credit is still required when due.• COMMERCIAL MERCHANDISING - Selling merchandise or products with my art on it like key chains, stickers and t-shirts is not allowed unless a fee and/or royalties is discussed, agreed upon and paid for. If you are looking for commercial work like this, please specify upfront as the fee can be 100-300% depending on what you are requesting.• Any confusion with my usage rights can always be privately messaged.

design t.o.s

general terms

Once you have purchased or acquired a design, you may:• Redesign it or rebase it.
Although it's required that you keep an unedited version of the design tied to the character.• Not make any edits on top of the original.
I can make minor edits for free, just reach out. Or just do it on a copied file so an unedited version is available.• Change or add it to a species.
Again, please keep an unedited version of the design tied to the character.• Ask before voiding any closed species adopts.• Trade, sell, swap, or gift the design itself away.
As long as you do not sell for more than what you purchased it for. However, gifted designs cannot be sold unless it has art that was commissioned or personally made.• Add monetary value to the designs worth.
From personal and commissioned art purchased for the design.Additionally:• I have the right to refuse any offers, even "autobuys" from people I deem as OC hoarders as I'd like my designs to be used.• Please keep my design on Toyhouse, do not delete their profiles without permission. You can just send it back to me.• If hiding their profile, grant me authorization in order to keep up with my design.• Do not sell/trade/gift my designs to people on my blacklist!
This goes for people who have blocked me as well.• Designs made for a closed species must abide the species’ TOS before my TOS.

payment

• I only accept USD. I also primarily use Paypal invoice when selling designs.• All offers must be serious and fully committed, back-outs are generally unacceptable unless it is an absolute emergency which needs to be communicated ASAP.• Unless stated, I accept 72 hour holds for offers less than 100 USD and longer for offers above 100 USD.• Payment plans are okay as long as a non-refundable down payment is required upfront.• If allotted time has passed with no communication or payment from buyer, the design will be placed back up for sale. Buyer is required to communicate first otherwise it be taken as ghosting.• Ghosting, back-charging, abuse of holds or multiple back-outs will result in being blacklisted, blocked, and/or denied future holds and purchases of my designs.

refund policy

• Unless the designer (@Mewynia) accepts or offers to buy back the design; no refunds are allowed once an adopt has been purchased.• Back charges results in you being blacklisted and losing rights to the design which allows it to be resold.

commercial rights

• All personally made adopts are automatically for private use unless stated. This does not apply for designs made from commissioning me, those come with full commercial rights (only for design, not the art itself).• Designs on Toyhouse that include commercial rights will have it stated in the ownership tab.• Please ask me directly for any inquiries regarding commercial use for designs.
